Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and NexApply ("NexApply", "we", "us", or "our") governing your use of the NexApply web app and "Save Job" browser extension (collectively, the "Service"). Please read them carefully.

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be a resident of the United States and at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, and you must be 18 or older (or have your guardian's consent and payment authorization) to purchase a paid subscription. By using the Service you represent that you meet these requirements.

2. The Service

NexApply helps you organize your job search — tracking applications, contacts, and documents — and offers AI-assisted drafting and insights. We may add, change, or remove features at any time. Some features are available only on a paid plan.

3. Your account

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly at support@nexapply.org if you suspect unauthorized use.

4. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its systems;
• scrape, resell, or redistribute the Service or its content except as expressly permitted;
• upload content that infringes others' rights or that you do not have the right to provide; or
• misuse AI features to generate unlawful, deceptive, or harmful content.

5. Your content

You retain ownership of the data and documents you submit ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service to you, including sending relevant text to our AI provider to generate the outputs you request. You are responsible for Your Content and for ensuring you have the right to submit it.

6. AI-generated output

AI features produce drafts and suggestions that may be inaccurate, incomplete, or unsuitable for your situation. AI output is provided for your convenience "as is", is not professional advice, and you are solely responsible for reviewing, editing, and deciding whether to use it.

7. Subscriptions, billing, and trials

• Plans. The Service offers a free tier with usage limits and paid "Pro" plans (monthly and a multi-month "Semester Pass"). Current pricing is shown on the upgrade page.
• Free trial. Paid plans may include a free trial. If you do not cancel before the trial ends, your subscription begins and your payment method is charged automatically.
• Recurring billing. Paid plans renew automatically at the end of each billing period until canceled. By subscribing, you authorize us, through Stripe, to charge your payment method on a recurring basis.
• Taxes. Listed prices are exclusive of tax; applicable U.S. sales tax is added at checkout.
• Cancellation. You may cancel at any time through the billing portal in Settings. Cancellation stops future renewals; your Pro access continues until the end of the current paid period.
• Refunds. Except where required by law, payments are non-refundable and partial periods are not prorated.
• Price changes. We may change pricing; we will give notice before changes apply to your next renewal.

8. Third-party services

The Service relies on third parties including Google (sign-in), Stripe (payments), and Cloudflare (hosting and infrastructure). Your use of those features may also be subject to the respective provider's terms, and we are not responsible for third-party services.

9. Intellectual property

The Service, including its software, design, and branding, is owned by NexApply and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal job search. You may not copy, modify, or create derivative works of the Service except as allowed by law.

10. Termination

You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Upon termination, the rights granted to you end; sections that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI OUTPUT WILL BE ACCURATE. NEXAPPLY DOES NOT GUARANTEE ANY JOB-SEARCH OUTCOME.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXAPPLY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $50.

13. Indemnification

You agree to indemnify and hold NexApply harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service, Your Content, or your violation of these Terms or applicable law.

14. Governing law and disputes

These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict-of-laws rules. Before filing a claim, you agree to first contact us at support@nexapply.org so we can try to resolve the matter informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in the State of South Carolina, United States, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide notice within the Service. Your continued use after an update constitutes acceptance of the revised Terms.
